The Law & Debt Collection

Emoluments attachment orders in South Africa
An emoluments attachment order in South African law is a court order whereby the judgment creditor is able to attach part of the salary or wages of the judgment debtor. Once an emoluments attachment order has been granted, the employer of the judgment debtor (who is referred to as the garnishee) is obliged (on a continuing basis, and until such time as the judgment debt has been paid in full) to pay a certain portion of the judgment debtor’s salary or wages to the judgment creditor.
The employer is known as the emoluments attachment debtor or garnishee. It is important to distinguish between the employer as an emoluments attachment order debtor, or garnishee, and the actual judgment debtor. Emoluments attachment orders are signed by the judgment creditor, or by a nominated attorney, as well as by the clerk, and are served by the sheriff on the emoluments attachment debtor or garnishee. An emoluments attachment order may be executed against the emoluments attachment debtor or garnishee as if it were a judgment of the court. The order is always subject to the rights of the judgment debtor, emoluments attachment debtor or any interested party to dispute the validity or correctness of the order.
The emoluments attachment order “is a good way of proceeding against a judgment debtor who does not possess sufficient attachable assets to pay off a significant portion of the debt.” Because the money goes directly from the employer to the judgment creditor, the latter’s attorney does not have to worry about the judgment debtor spending it before it can be attached. The judgment debtor also has an interest in retaining his job. As long as he does so, the debt will continue to be paid.
In terms of section 65J(2)(a) and (b), an emoluments attachment order will not be issued unless the judgment debtor has consented thereto in writing, or the court has so authorised and does not suspend the authorisation;
Unless the judgment creditor or an appointed attorney has
• sent a registered letter to the judgment debtor at his or her last known address informing the judgment debtor of the amount of the judgment debt and the costs which remain unpaid, and also warning that an emoluments attachment order will be issued if the mentioned amount is not paid within seven days after the date on which that registered letter has been posted; and
• filed with the clerk an affidavit or affirmation wherein is indicated
• the amount of the judgment debt on the date of the order laying down the specific instalments;
• the costs, if any, incurred since that date; and
• the balance owing; and
• it is declared that the provision above, requiring the sending of the registered letter, have been complied with on the date specified therein.tisfy the judgment debt and costs.

Continues Next Week…

Navrae kan aan Melanie Smit by (044) 606-5125 (msmit@mosselbay.gov.za) of Rónell du Toit by (044) 606 5149 (rdutoit@mosselbay.gov.za) gerig word.

Hartenbos Apteek baie geluk – julle is waardige wenners !!

Volgende jaar maak ons weer so !!!

GOLD FOR MOSSEL BAY CHESS

After two weeks of hectic competition, Mossel Bay Chess Club was crowned Premier League Champions of the Eden Chess Union (Previously known as SWD Chess Union).

The six member team, consisting of Ralph Cloete (team captain), Bjorn October, Morne Matthee, Gurome Gelderbloem, Chaiden Kiewit and Wayne Jordaan won the title after a defeat against George A (1-3), a draw against Riversdale (2-2), and victories against Oudtshoorn A (2½-1½), Oudtshoorn B (4-0) and Hoërskool Outeniqua (3-1).

Their achievement was made even more remarkable by the fact that the club did not have a meeting venue since its regular venue, All Saints Church Hall, has been closed for renovations since November 2014. Club Chairperson, Ralph Cloete expressed his concern with the current state of affairs, especially because youngsters in the Mossel Bay community are denied an opportunity to participate in a sport, whose contribution to the intellectual development of the young human being is indisputable.
The Club therefore makes a call on citizens who can assist the club with a venue to contact Mr Cloete (083 215 6241) or Mr H Willemse (079 452 1300), the Club Secretary. Mossel Bay Chess Club would also like to inform all chess players, old and young, of the Mossel Bay Chess Open Tournament during the Mossel Bay Sports Festival which will be held at Garden Route Casino & Hotel from the 3rd to 4th October 2015.

A community project to combat the plight of battered women and children especially in the Southern Cape

MORE Earth Angels. Joins the ranks! The ‘silent crime’ of women and child abuse with Natasha Sutherland, better known as the author motivational speaker of “Bitter Sweet”, is joining forces to create public awareness.

The ‘silent crime’ of women and child abuse with Natasha Sutherland, better known as the author motivational speaker of “Bitter Sweet”, is joining forces to create public awareness.

Natasha became involved FIVE years ago at Miss Garden Route when she paid a visit to all the involved shelters. She was totally overwhelmed by the work done by the volunteer ‘angels’ in very difficult circumstances and decided to link the awareness of the plight of these women to her Big HEART FOUNDATION. She also made an effort sending goods which was donated by the general public to the shelters involved.

Even if you are not a star, a public figure or a celeb, you and/or your organisation can become “angels behind the scenes” by getting involved in this very worthy cause which represents a large percentage of the women and children in our country.

The plight of battered women and children all over the country, but especially in the Southern Cape is highlighted by the annual Miss Garden Route & Klein Karoo project which initially started as a beauty pageant some years ago, but has grown into the celebration of women that have seen the darker side of abuse.

This project started in 2003 and has grown into a community effort. At present four shelters in the Southern Cape: Centre for Effective Families (CEF) in Mossel Bay, Malibongwe in Oudtshoorn and Phambile in George and Knysna’s shelter Lukhanyiso benefit from the proceeds.

YOU too can become involved in this project and make a difference not only to the lives of these women and children, but also to the community at large.

The Beauty with a Purpose Project is focused on granting a platform to our local community by means of the following four levels:
a) Beauty : Undiscovered beauties have the opportunity to enter the “tourism face” competition winning a magnitude of prizes.

b) Design : Local designers are invited to display their talents. Six local designers are chosen to design two garments each.

c) Tourism : Tourism role-players get the opportunity to market their businesses. The 12 finalists experience a tour of the region which includes the shelters.

d) Charity : All proceeds generated are donated to selected shelters for battered and abused women and children in the region. Malibongwe in Oudtshoorn, Phambili in George, Creating Effective Families in Mossel Bay and Lukhanyhiso shelter in Knysna.
Educational week (21 – 25 September)
In order to be true ambassadors of the region, all 12 finalists will this year be taken on a variety of tourism educationals. At this stage, tours will depart on 21 September for the first visit to Oudtshoorn area visiting other tourism attractions, culminating to the gala evening taking place on Friday, 25 September 2015.
