MANDELA DAY 2017

Nelson Mandela International Day, also known as Mandela Day, is an international day in honour of Nelson Mandela, celebrated on 18. July 2017. On this day, Mandela was born in 1918, so it celebrates his birthday. The day was officially declared by the United Nations in November 2009, with the first UN Mandela Day held on 18 July 2010.
Mandela Day is not meant as a public holiday, but as a day to honour the legacy of Nelson Mandela, South Africa’s former President, and his values, through volunteering and community service. The day is a global call to action that celebrates the idea that each individual has the power to transform the world, the ability to make an impact.

 

Nelson Mandela, who died in 2013, was a South African anti-apartheid revolutionary, politician and philanthropist who served as President of South Africa from 1994 to 1999. He was South Africa’s first black chief executive, and the first elected in a fully representative democratic election. His government focused on dismantling the legacy of apartheid through tackling institutionalised racism, poverty and inequality, and fostering racial reconciliation. (With material from: Wikipedia)

CHRISTMAS IN JULY

Between Mossel Bay and George is a relatively new quaint wedding venue called Trinity Gate. Ben Koorsen, the well-known hairdresser and owner of Zoe Hair in Mossel Bay and David van Schalkwyk, owner of The Winners Group – an International Incentive Travel Company based in Cape Town bought the farm in December 2015. Both originate from the area – Ben from Mosselbay and David originally from Oudtshoorn and their dream was always to return to the Garden Route. David explained,”Once we saw the farm, the entire layout, energy and tranquillity simply shouted – Function Venue!”

GROOT BRAK RIVER YOUTH CAFÉ LAUNCH

To conclude Youth Month commemorations, the Western Cape Department of Social Development (DSD) launched the Groot Brak River Youth Café.

The Groot Brak Youth Café, launched on Friday (30-06-2017), is the provinces 7th Youth Café and comes after the recent launch of the Mitchells Plain Youth Café earlier in June.

The Groot Brak Youth Café is a new facility R6.5-million facility. It is the product of our partnership with PetroSA, which funded the construction of the building, and the Mossel Bay Municipality which availed space and ongoing support.

The Department has contracted our NGO partner, the Wonderful SA Foundation, to operate the facility, and render services to young people on behalf of the Department.
The location of the Groot Brak Youth Café allows for young people living in poorer and more rural parts of Mossel Bay to have access to world-class facility.

The launch was attended by officials from DSD, Wonderful SA CEO, Michael Puffet, Mossel Bay Mayor, Ald. Harry Levendal, Western Cape Provincial Parliament Deputy Speaker, Piet Pretorius and Provincial Minister for Sports & Culture, Anroux Marais.
As per the Provincial Youth Development Strategy, the Youth Café is tailored to offer opportunities for young people broadly referred to as “NEETs”, namely young people not in employment, education or training.
Along with a good cup of coffee, the Groot Brak Youth Café will provide internet access and computer access to budding entrepreneurs and aspirant job-seekers. In addition, the facility will render opportunities and training in;

Work Ethic,
Entrepreneurship,
Leadership development,
Life Skills Sessions
Creative Design,
Event Management,
Project Management.

Even as we conclude Youth Month, the Department will continue to roll out services and opportunities to young people, and has allocated R15.6-million this financial year to youth services.

KAN MY MAN OOK MY BESIGHEIDSVENNOOT WEES?

“Ek en my man is buite gemeenskap van goedere getroud, sonder aanwas. Vir die laaste tien jaar het ons albei saam in ons familiebesigheid gewerk. Vir gesondheidsredes, raak my betrokkenheid in die besigheid al minder. Ons huwelik gaan ook deur ‘n moeilike tyd, en ek is bekommerd of, sou ons dalk skei, ek geregtig sal wees om te deel in die wins van die besigheid wat ons saam opgebou het.”

Die Suid-Afrikaanse reg erken al sedert 1945 die bestaan van universele vennootskappe tussen gades wat buite gemeenskap van goedere getroud is. ‘n Universele vennootskap kan bestempel word as ‘n vennootskap waar elk van die partye iets tot die vennootskap bydra – of dit nou geld, vaardighede of arbeid is – en waar die vennootskap, met die doel van winsmaking, voortduur tot voordeel van beide partye.

Ons howe het die laaste tyd te doen met die eienaardige situasie, soortgelyk aan joune, waar gades, getroud buite gemeenskap van goedere en sonder die aanwasbedeling, eise indien wat gegrond is op die bestaan van ‘n universele vennootskap tussen die gades. Wanneer gades kies om buite gemeenskap van goedere sonder aanwas te trou, kom hulle basies kontraktueel ooreen deur middel van ‘n voorhuwelikse kontrak om elk hul eie afsonderlike boedel te behou en gevolglik word geen gesamentlike boedel gevorm nie. Die eienaardigheid onstaan dus wanneer, ná die sluiting van sodanige voorhuwelikse kontrak, ‘n gade wil deel in die wins van ‘n vennootskap gevorm tussen die gades, wat daardeur die terme van die voorhuwelikse kontrak weerspreek.

Ons reg maak voorsiening vir twee tipes universele vennootskappe: 1) waar die partye instem om al hul huidige en toekomstige bates te deel; en 2) waar die partye instem om al die bates soos bekom deur ‘n kommersiële onderneming, te deel. Die verskil tussen die twee vennootskappe is duidelik. In die eerste geval, stem die partye in dat hulle al hul bates wat hulle reeds bekom het en nog in die toekoms sal bekom, sal deel – wat ‘n “nie-kommersiële” vennootskap genoem kan word. In die tweede geval, word slegs daardie bates gedeel wat bekom is as gevolg van ‘n kommersiële onderneming – wat as ‘n “kommersiële” vennootskap bekend staan.

Ons howe het sonder enige moeilikheid bevind dat “kommersiële” vennnootskappe regtens geldig is, selfs waar gades wat ook vennote is, getroud is buite gemeenskap van goedere sonder aanwas. In ‘n onlangse saak het die hof bevind dat gades wat ‘n vennootskapsooreenkoms gesluit het ten opsigte van die vestiging van ‘n visplaas, beskou is as ‘n regsentiteit apart van hul huwelik en dat hulle kan deel in die wins, wat na hul afsonderlike boedels sal toeval, nes dit sou gebeur as hulle gewone besigheidsvennote was.

Waar gades nié ‘n vennootskapsooreenkoms onderteken het nie, het ons howe bevind dat in die geval van ‘n “kommersiële” vennootskap, ‘n vennootskap ook stilswyend kan vorm, en om te bepaal of ‘n stilswyende ooreenkoms bestaan, die howe sal kyk na die woorde en dade van die partye om te bepaal of sodanige vennootskap bestaan het. Waar die partye se gedrag lei tot meer as een afleiding, is die toets vir die bestaan van ‘n stilswyende universele vennnootskap of dit meer waarskynlik as onwaarskynlik is dat ‘n stilswyende ooreenkoms bereik is. Hieruit word dit duidelik dat ons howe hul eie benadering ontwikkel betreffende die erkenning van universele vennootskappe.

In jou geval, in die afwesigheid van ‘n duidelike vennootskapsooreenkoms wat die bestaan van ‘n vennootskap bevestig of ontken, is daar ‘n sterk moontlikheid dat jou betrokkenheid met jou man in die familiebesigheid die nodige gronde bied om erken te word as ‘n stilswyende universele vennootskap, en jy dus in staat sal wees om, in geval van egskeiding, aan te dring op jou aandeel in die familiebesigheid. Dit is egter raadsaam om die hulp van ‘n familiereg-spesialis in te win om jou te help om jou posisie ten opsigte hiervan te bepaal, sowel as om te oorweeg of die sluiting van ‘n duidelike vennootskapsooreenkoms nie die beste manier is om toekomstige onsekerheid te verhoed nie.

DCAS HANDS OVER FUNDING FOR QUALITY SPORT FACILITIES IN COMMUNITIES

On 4 July 2017, Western Cape Minister of Cultural Affairs and Sport, Anroux Marais handed over ceremonial cheques to the value of R1 471 000 to the Mayors of the Breede Valley, Mossel Bay and Overstrand Municipalities for quality sport facilities in vulnerable communities.
Mossel Bay Municipality received R200 000 for a new netball facility.

The Head of the Department of Cultural Affairs and Sport (DCAS) Brent Walters welcomed the Mayors and other esteemed guests and mentioned that the National Sport and Recreation Plan (2012) (NSRP) makes provision for the development of sport facilities in vulnerable communities as one of the 14 key enablers for a conducive sport environment.

DCAS engaged with municipalities in the Western Cape on their specific needs and embarked on the allocations of the 2017/18 funding in the various regions of the province. The Breede Valley Municipality received a contribution of R100 000 to fund a feasibility study for the planning of a swimming pool facility in Zwelethemba and the Mossel Bay Municipality received R200 000 for a new netball facility. The Overstrand Municipality, Hermanus High School, Overberg Sport Council and the WP Hockey Federation partnered to develop a Hockey Academy. The DCAS contribution of R1 171 000 will fund the completion of the change rooms and clubhouse facilities.

Minister Marais encouraged the municipalities to take ownership of the facilities and to maintain and respect them. “These are invaluable assets to the enrichment of the livelihoods of all who will use them for constructive development”, she said.

DCAS supports municipalities to build sport infrastructure and encourages communities to participate in the activities at these quality sport facilities. Let’s leave a lasting sport legacy in our communities BETTER TOGETHER.

CENTRAL ENERGY FUND APPOINTS NEW INTERIM BOARD AT PETROSA

The Central Energy Fund has removed the remaining two board members of PetroSA and appointed an interim board.

Six board members resigned from the ailing parastatal in June after the fund’s chairman, Luvo Makasi, instructed its members to resign with immediate effect, or submit oral representations at the annual general meeting as to why they should stay.
The Central Energy Fund is PetroSA’s holding company.

In May, Business Day was informed that two members had tendered their resignations.
The two remaining board members, Owen Tobias and William Steenkamp, were not included on the interim board.

PetroSA said on Wednesday the decision to replace the board was the culmination of engagements with all parties concerned. It also took cognisance of the financial stability and strategic direction of the entity.

The fund’s new board, which was appointed with effect from July 5, are Nhlanhla Gumede as chairman, Leanne Williams, Quentin Mathew, Noto Eister, Puleng Kwele, Boy Manqoba Ngubo, Nomvuselelo Songelwa, Sepheu Simon Masemola and Mthozami Xiphu.

The Central Energy Fund’s board said the new PetroSA team would bring the “relevant industry experience and strategic acumen”.
“Their combined experience will further support the strategy to deliver value to the entity’s stakeholders through good governance, operational excellence and continued growth,” it said in a statement.
PetroSA has suffered huge losses over the past three years and has a projected loss of R2.2bn for the financial year to March 2017.
This follows its record R14.6bn net operating loss in the 2014-15 financial year.

In June, the PetroSA board made a presentation to the Central Energy Fund in which it said there was no risk that the company was no longer a going concern. It had denied mismanaging the entity.
The board added in its presentation that it had taken several steps to ensure that lessons learnt from the failure of Project Ikhwezi were applied.

In the project gas wells were drilled offshore to provide feedstock for PetroSA’s Mossel Bay gas-to-liquid refinery‚ which had led to the huge losses after limited gas reserves were discovered. Some of the PetroSA board members had resigned before the presentation and some afterwards.

Business Day has reported that the board of the troubled oil company had requested the Central Energy Fund place it under business rescue, raising questions about its status as a going concern. However, this has been denied by PetroSA.

ASSISTANCE TO A BOAT AND CREW OFF-SHORE OF LITTLE BRAK

At 14h02, Sunday, 09th July, NSRI Mossel Bay duty crew were activated following a request for assistance from the recreational fishing craft Just 4 Play reporting to have run out of fuel near to the Orca Drilling Platform off-shore of Little Brak with 6 crew onboard.

The sea rescue craft Rescue 15, on a routine exercise at the time, collected fuel for the casualty craft and on arrival on the scene fuel was supplied to the craft and 2 of the 6 crew were taken off the craft, one a 22 year old male suffering hypothermia and one a 35 year old male suffering back pain that had reportedly been sustained onboard the boat when the man had fallen on the boat earlier.

By Grace ambulance services responded to the Mossel Bay sea rescue station and on arrival of the sea rescue craft the man suffering back pain was transported to hospital in a stable condition by ambulance and NSRI medics rewarmed the hypothermic man and he was released after being re-warmed and no further assistance was required.
